Collaborative Divorce
Since 2001 my firm has been representing individuals in family law matters using this process. This process is designed to assist the parties in resolving their case without the usual acrimony, emotional trauma, and financial devastation that many experience through the traditional court process.
Both parties must be committed to the principles of the collaborative process which are:
- Not using court or the threat of court
- Meaningful communication
- Creating trust
- Doing what is best for their children
- Making full and honest disclosures of assets
The traditional court process can have a devastating effect on the parties, their children, and cause depletion of assets. Everyone has heard how court-contested divorces can be emotionally and financially draining. Collaborative divorce is a welcome alternative.
Collaborative divorce allows both parties to be represented by their own specially trained lawyer whose job is to assist them in settling their case without court involvement. The process is based on building trust between the parties that enables them to find ways of resolving their case with the least amount of conflict.
In this process, the parties have much more control over their destiny as opposed to contested court proceedings which leave the parties feeling helpless.
Early, non-adversarial participation by the attorneys allows each party to use analysis and reasoning to solve problems, and generate options creating a positive context for settlement.
Besides the attorneys, other professionals such as mental health persons, financial planners, and accountants can be brought in to further assist the parties when necessary to insure a successful resolution.
